On July 1, 2024, India began a historic path of legal reform, replacing its colonial-era criminal laws with a new set of statutes known as the Bharatiya Nyaya Sanhita (BNS), the Bharatiya Nagarik Suraksha Sanhita (BNSS), and the Bharatiya Sakshya Adhiniyam (BSA). These new laws, known together as the ‘New Criminal Laws,’ represent a considerable change from the Indian Penal Code (IPC), the Code of Criminal Procedure (CrPC), and the Indian Evidence Act (IEA), which had been in effect since 1860, 1973, and 1872, respectively.
The new criminal laws seek to modernize and streamline India’s criminal justice system, aligning it with current requirements and ideals. They stress the notion of ‘Nyaya,’ which means justice, over punishment, indicating a trend towards a more restorative approach to criminal law.
